The Marks family has a rich heritage of family stories. It has been said that there was never a story told that a Marks couldn’t improve upon. Many of these stories have been preserved for us in MARKS-BARNETT FAMILIES AND THEIR KIN by Marion Dewoody Pettigrew and Newton Edward Brightwell, Jr., Pub 1981, Gateway Press, inc. Baltimore. The stories are woven into this history of the Marks family along with the hard data which make up a well researched genealogy. Unless otherwise indicated, this book is the source for the information on these pages. Abeyance (from the Old French abeance meaning “gaping”) is a state of expectancy in respect of property, titles or office, when the right to them is not vested in any one person, but awaits the appearance or determination of the true owner. In law, the term abeyance can only be applied to such future estates as have not yet vested or possibly may not vest. For example, an estate is granted to A for life, with remainder to the heir of B. During B’s lifetime, the remainder is in abeyance, for until the death of B it is uncertain who is B’s heir. Similarly the freehold of a benefice, on the death of the incumbent, is said to be in abeyance until the next incumbent takes possession. [1]

The term hold in abeyance is used in lawsuits and court cases when a case is temporarily put on hold.

History

The most common use of the term is in the case of English peerage dignities. Most such peerages pass to heirs-male, but the ancient baronies created by writ, as well as some very old earldoms, pass instead to heirs-general (by cognatic primogeniture). In this system, sons are preferred from eldest to youngest, the heirs of a son over the next son, and any son over daughters, but there is no preference among daughters: they or their heirs inherit equally.

If the daughter is an only child or her sisters are deceased and have no living issue, she (or her heir) is vested with the title; otherwise, since a peerage cannot be shared nor divided, the dignity goes into abeyance between the sisters or their heirs, and is held by no one. If through lack of issue, marriage, or both, eventually only one person represents the claims of all the sisters, he or she can claim the dignity as a matter of right, and the abeyance is said to be terminated. [1] On the other hand, the number of prospective heirs can grow quite large, since each share potentially can be divided between daughters, where the owner of a share dies without leaving a son.

A co-heir may petition the Crown for a termination of the abeyance. The Crown may choose to grant the petition, but if there is any doubt whatsoever as to the pedigree of the petitioner, the claim is normally referred to the Committee for Privileges. If the claim is unopposed, the Committee will generally award the claim, unless there is evidence of collusion, the peerage has been in abeyance for more than a century, or the petitioner holds less than one-third of the claim.

This doctrine is a 17th-century innovation, although it is now applied retrospectively for centuries; the seventh Baron De La Warr had three surviving sons; the first died without children, the second left two daughters, the third left a son. In modern law, the title would have fallen into abeyance between the two daughters of the second son, and nobody else would have been able to claim it even if the abeyance were settled; in 1597, the grandson of the third son claimed the title and its precedence. In 1604, the Baron le Despencer case was the first peerage abeyance ever settled; the second was at the Restoration in 1660. Most subsequent abeyances (only a few dozen cases) were settled after a few years, in favour of the holder of the family properties; there were two periods in which long-abeyant peerages (in some cases peerages of doubtful reality) were brought back: between 1838 and 1841 and between 1909 and 1921. [2] Abeyance can apply to certain ancient earldoms, but only baronies have been called out of abeyance. [3]

It is entirely possible for a peerage to remain in abeyance for centuries. For example, the Barony of Grey of Codnor was in abeyance for over 490 years between 1496 and 1989, and the Barony of Hastings was similarly in abeyance for over 299 years from 1542 to 1841. Some other baronies became abeyant in the 13th century, and the abeyance has yet to be terminated. The only titles other than a barony that have yet gone into abeyance are the earldom of Arlington and the viscountcy of Thetford, which are united, and (briefly) the earldom of Cromartie.

It is no longer straightforward to claim English peerages after long abeyances. In 1927 a parliamentary Select Committee on Peerages in Abeyance recommended that no claim should be considered where the abeyance has lasted more than 100 years, nor where the claimant lays claim to less than one third of the dignity. [4] The Barony of Grey of Codnor was treated as an exception to this principle, as a claim to it had been submitted prior to these recommendations being made to the Sovereign. [5]

Titles in the Peerage of Scotland cannot go into abeyance, because in Scottish law the eldest sister is preferred over younger sisters; sisters are not considered equal co-heirs.

It is common, but incorrect, to speak of peerage dignities which are dormant (i.e. unclaimed) as being in abeyance. [1]

1734: Baron Clifford after 5 years; (again in 1776 and 1833 after a year)

1764: Baron Botetourt after 358 years; again in 1803 after 21 years.

1780; Baron Willoughby de Eresby after a year; again in 1871 after a year.

1784: Baron Howard de Walden after 96 years; [11] again in 2004 after five years.

Abeyance can be used in cases where parties are interested in temporarily settling litigation while still holding the right to seek relief later if necessary. This may be considered a desirable outcome in cases where the party to the lawsuit is an organization with a transient membership and political perspective. The use of abeyance in such instances can allow such an organization to ‘settle’ with the party without officially binding its actions in the future, should a new group of decision makers within the organization choose to pursue taking the dispute to court.

For example, abeyance was used as a settlement method in a Canadian lawsuit involving the University of Victoria Students’ Society (UVSS), the BCCLA, and a campus pro-life club to whom the UVSS denied funding. The parties agreed to settle the lawsuit by holding the case in abeyance in return for the UVSS temporarily giving resources back to the club. With this arrangement, the pro-life club held on to its right to immediately reopen the case again should the UVSS deny resources to the club in the future, and the UVSS was able to avoid an expensive legal battle it did not have the will to pursue at the time. Thus the use of abeyance provided the security of a settlement for the pro-life campus club, while preserving the student society’s voting membership’s ability to take the matter back to court should they choose in the future to deny resources to the club. Other court cases may be held in abeyance when the issue may be resolved by another court or another event. This saves time and effort trying to resolve a dispute that may be made moot by the other events. During lawsuits related to the Patient Protection and Affordable Care Act (ACA, Obamacare) after the Supreme Court of the United States granted certiorari in King v. Burwell attorneys in Halbig v. Burwell requested abeyance of that case as the matter would be resolved in King and it would be a waste of time and effort to try and resolve it in the Halbig case. [13]

JOHN MARKS and ELIZABETH HASTINGS, In Pettigrew, Marian Dewoody & Brightwell, Newton Edward, MARKS-BARNETT FAMILIES AND THEIR KIN, p. 1-5, Mrs. Pettigrew, writing in 1939, offers the following observations:

First Generation

MARKS is a name admitting of few variations, and those probably due to the peculiarities of that period of our history when every man spelled according to his own inclination. However, we find the name written as Marks, Marx, Marche, Markes, March, etc. In England it is a name common in many localities, especially in Suffolk shire, and is one of the old English names which strangely enough is at present more prolific and illustrious in this country than in England.

The Marks in early days were noted for their wealth,and have been landed proprietors since early times. The family is noted for its intelligence and influence, their chief characteristics are well balanced minds and sound judgment: they are big hearted, public spirited citizens, upright, and even unto the present generation they are honest, not only in business, but in all their dealings with their fellowman. It is seldom you find one that is not bent to an honest purpose, most of them are of deep convictions, and determined in maintaining their opinions.

Without interesting traditions, family histories would be prosaic reading. How many valuable records would be unearthed, if we could only follow the persistent traditions that crop up in every family to their source. the Hastings-Marks line fairly teems with them dating from the days in old England to the settlement of the family in the Colony of Virginia, and romance abounds.

It is said also that John Marx was a Jew , and eloped with Lady Hastings against the wishes of her family, the opposition being so great that he brought his wife to America. settling in Virginia, at Charlottesville, in Albemarle County. They changed their name from Marx to Marks, gave their children Christian names, and reared them in the Christian faith. The latter form of spelling has been handed down in this branch of the family.

The tradition of the Jew exists only in some branches of the family, some do not accept it in any version, and others have never even heard of it. Some are of the opinion, or rather a tradition has been handed down to them that John Marx was a barrister, or counselor at law, and was not considered the social or political mate for the high born daughter of the house of Hastings, which besides being royalty itself, boasted of many distinguished members; at any rate this couple left their native land and all their people, and sought a home in this more democratic nation.

First Grneration

They brought with them nothing that would bind them to the past, not even records. The tradition of Jewish origin has not only been understood in the compiler’s branch of the family, but has been accepted as a fact. Mrs. Foster who has given the subject much time and thought writes, “We have the foregoing Jewish tradition that was accepted by my grandmother in Georgia, who got it from her uncles after they came West, thence to New Orleans, she in turn beccame the sole authority for us of the younger generation.”

The pros and cons of the Jewish theory are about evenly divided and as it seems inpossible to verify either version we will waste no time in trying to force an acceptance of one or the other. There is much that could probably be learned about the Marks and Hastings alliance, but so far no proof of this connection has been forthcoming. Research has not been of very much avail, it ramains for some member of the family to make personal investigation of the families in England.

The Hastings’ family recored should reveal the mariage of Elizabeth, of Anne Hastings, into the Marx (Marks) family. The other part of the tradition says that she was disinherited by her people for her misalliance, and that her name was expunged fromtheir records. If that is true, they cleared the records so thoroughly that it has been inpossible to make a satisfactory research along either line. So we will begin our record with John Marks and his wife Elizabeth Hastings, of England. Child or grandchild or possibly great grandchild:

p. 3-4; John Marx (Marks) of Suffolk County, England, married Elizabeth Hastings, also of England, about 1680-1685; this date is tentative, and may not be correct, but is given here as a working basis. It is said they came to America to cast their lot, and settled near Charlottesville, Virginia. It is supposed to have been at this time that the name was changed from Marx to Marks, which latter form has been handed down through the generations.

Wood’s HISTORY OF ALBEMARLE COUNTY, VIRGINIA, gives a list of their children. But we find that this list is incorrect. There is a difference of almost a century betwen their marriage and the marriage of Sarah, in 1782, who is listed as their daughter, in Wood’s History, p 263.
